1. RENT-TO-OWN SCOOTER TERMS
1.1 Rent-to-Own Scooter
User acknowledges and agrees that User desires to own the Scooter (as described below in Paragraph 1.2). User shall only own the Scooter once User has paid the Deposit (as described in Paragraph 1.3); all twelve (12) of the Monthly Payments (as described in Paragraph 1.4); and/or any and all additional fees and/or expenses owed by User to Moon Scooters via the terms of the Scooter Subscription Agreement. https://moonscooters.github.io/public-docs/rental-agreement
1.2 Description of Scooter
Scooter means the electric scooter provided by Company to Users as part of the Services pursuant to Rent-to-Own and the terms of the Legal Terms. The term "Scooter" includes the Battery and Lock unless otherwise specified (the “Scooter”).
1.3 Deposit
User agrees to make an initial non-refundable, to the extent permitted by law, deposit (the “Deposit”) in the amount of $50 no later than the moment User receives the Scooter. If User already has a deposit, they can add to it to bring the total Deposit to $100. The Deposit is required to start the program and will be credited towards the monthly rental payments. If no payment is made, Moon may request the return of the scooter. If Moon has to pick up the scooter, the $50 deposit may be affected.
1.4 Monthly Payments
User agrees to make twelve (12) monthly payments of $100 each (the “Monthly Payment”) to Moon Scooters. The initial monthly payment shall be paid no later than the moment User receives the Scooter.
1.5 Option to Switch from Rental to Rent-to-Own
If User initially opted for a rental agreement, User has the option to switch to a rent-to-own agreement at any time. If User chooses to make this switch, the Deposit (as described in Paragraph 1.3) must be made immediately prior to the switch, and the monthly payments made under the rental agreement will be counted towards the twelve (12) Monthly Payments under the rent-to-own agreement.
1.6 How to Sign Up
Start with a Rental: Sign up for a regular month-to-month rental through our app.
Contact Us: Text our team to switch from a rental to the rent-to-own program.
1.7 Payment Flexibility
Late Payments: If a payment is late, you have the option to switch back to a standard rental plan at $80 per month.
Missed Payments: If no payment is made, Moon may request the return of the scooter. If Moon has to pick up the scooter, the $100 deposit may be affected. If Moon is unable to pick up the scooter within ten (10) days after a missed payment, we may assume the property is stolen and involve law enforcement. If the payment is overdue by more than thirty (30) days and Moon has not received the scooter back, the entirety of the rent-to-own credit may be forfeited, and Moon will not permit re-enrollment in the rent-to-own program.
1.8 Return and Credit Policy
User may return the Scooter at any time during the twelve (12) month period from the Effective Date from the moment User receives the Scooter. Should User return the Scooter to Moon Scooters prior to paying the Deposit and all twelve (12) of the Monthly Payments, User shall not have any ownership in the Scooter and no payments made by User to Moon Scooters as of the date of return of the Scooter shall be refunded to User.
1.9 Re-Enrollment Policy
If you need to leave the rent-to-own program but wish to re-enroll later, we make it easy. For example, if you make payments for six (6) months and then return the scooter, you can restart the program where you left off. When you re-enroll, you'll start at month 7, continuing to make monthly payments until you complete the twelve (12) month plan. Please note that you may need to make a new $100 deposit or a partial deposit if the previous deposit was affected by previous circumstances. Moon will not hold your rent-to-own scooter if you pause and re-enroll; you may be provided a different scooter. Moon cannot guarantee that scooters will be readily available upon re-enrollment. If the rent-to-own program has been paused for more than one (1) year, you cannot re-enroll but may petition if there are extenuating circumstances. Moon will handle such petitions on a case-by-case basis. If there is significant damage to the rent-to-own scooter during the pause of the rent-to-own program, Moon may charge the customer, which will affect the rent-to-own credit or deposit.
2. REPAIRS AND SERVICING
2.1 During Rental Period
A loaner scooter is provided for free during rental periods while your scooter is being repaired.
2.2 For Owners
We are working on providing a similar program for owners, but it is not yet finalized.
2.3 Repair Notifications
Moon Scooters will repair your scooter and notify you when it's ready to swap back. You must pick up the your rent to own scooter within 7 days of the notification is sent, if not, Moon Scooters may charge a prorated monthly rental fee for every day after.
3. WARRANTY
3.1 One-Year Warranty
Enjoy a one-year warranty after your final payment is made.
3.2 Warranty Coverage
Covered: Motor, battery, and controller issues; electrical system failures; frame defects; brake system failures not related to normal wear and tear.
Not Covered: Tires, brake pad wear and adjustments; cosmetic damage; accidental damage; issues from unauthorized modifications or improper use.
